it's not oil. well you can say tranny oil or motor oil. same shit..but yeah it's not flush. you can still drive it but chances are it's going to pop out. what tranny did you put in. i hope it's the same tranny.
The axle isn't seated all the way, or the axle seal is torn in the new trans. Jack up the car, drain the trans, pop the axle out and inspect the seal. Make sure there are no tears or chunks missing. If there is, just swap with the good seal from your old trans.

check your seal in the tranny where the axle goes in and if thats not the problem check the medal ring on the end of the axle and see if its loose or not if loose then there goes your problem

You should hear a little "pop" or "click" sound if you will when your axle seats. The snap ring on the end of the axle expands when it gets in its groove which makes the little "click" or "pop" noise. I would highly reccomend replacing the snap rings if they are at all out shape or dont have good tension in them. If you are having trouble getting it seated all the way in don't be afraid to give it a little love tap on the end of the axle with a towel over it and a SMALL hammer.

Axle not in all the way - bad seal. The only two likely problems.
